JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is surprising enough that the informant disclosed in his written report that the marriage of the deceased had taken place 20 years ago with petitioner but even then, the then officer-incharge of Nabinagar police station registered a case under section 304B of the Indian Penal Code. In course of investigation, not a single prosecution witness came forward to claim himself to be an eye witness of the alleged occurrence and it appears from perusal of the impugned order that some circumstantial evidence is said to have been collected by the I.O. Petitioner happens to be husband of the deceased.

Accordingly, let the petitioner, above named, be

Patna High Court Cr.Misc. No.41145 of 2015 (2) dt.11-09-2015 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S.case No. 51 of 2015.
