JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 15.6.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
It is alleged that Kameshwar Rai assaulted on the head of informant's father, thereafter others including the petitioner assaulted on the body of informant's father.
It is submitted by the learned counsel for the petitioner that the accusation is not specific against this petitioner and the postmortem is not on record. This fact has not been controverted by the learned APP, after going through the case diary. It is further submitted that for the occurrence of 24.1.2014, the FIR has been registered on 11.3.2014 whereas the fardbeyan was recorded on
Patna High Court Cr.Misc. No.41277 of 2014 (3) dt.23-01-2015 2/2 1.2.2014. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Riga P.S. Case No. 50 of 2014.
