JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Kadam Kuan P.S. Case No. 01 of 2017 disclosing offences under Sections 420, 138, 406 and 504 of the Indian Penal Code. Learned counsel for the petitioner at the very outset has submitted that the petitioner is ready to pay the entire amount of Rs. 1,46,000/-, which is due amount, out of Rs. 1,50,000/- in installments to the informant. It is undertaken on behalf of the petitioner that the petitioners had paid a sum of Rs. 4,000/- and remaining amount in monthly equal installments of Rs. 5,000/- shall be paid to the informant on or before 15th of every

Patna High Court Cr.Misc. No.47576 of 2017 (4) dt.04-01-2018 2/2 subsequent month, till the entire dues is satisfied. Considering the submission, this application is allowed.

Let the petitioners, above named, in the event of his arrest of surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-VIIth-Cum-Additional Chief Judicial Magistrate, Patna in connection with Kadam Kuan P.S. Case No. 01 of 2017 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. It will be open to the informant to approach this Court for cancellation of bail bonds of the petitioner if he fails to abide by the undertaking given by the petitioner as indicated in the present order.
