The petitioner seeks bail in G.R. No. 7672 of 2018 arising out of University P.S. Case No. 44 of 2018, instituted for the offence under Section(s) 406, 409, 467, 468, 420 and 120(B)/34 of Indian Penal Code.

Counsel for the petitioner submits that petitioner is not employee of the College. The tabulation register is filled up by the teachers manually in their handwriting who were deputed for tabulation. Petitioner is neither Professor nor Assistant nor members of the tabulation team.

In the written report it is alleged that petitioner along with other members of special tabulators have committed irregularities in posting of marks in tabulation register at Tabulation Center, Laxmi Narain College, Bhagwanpur,

Patna High Court CR. MISC. No.51828 of 2019(2) dt.26-08-2019 2/2 Hajipur, and qualified several examinees by taking illegal gratification.

It is mentioned in the written report itself which has been filed by the Registrar of Babasaheb Bhimrao Ammedkar Bihar University, Muzaffarpur, that petitioner is not employee of the University in any capacity. He was not even engaged on daily wages.

Petitioner is in custody since 1.7.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-8th-cum-ACJM, Muzaffarpur, in connection with G.R. No. 7672 of 2018 arising out University P.S. Case No. 44 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
