2. The petitioner has preferred this application for grant of regular bail in connection with Rajnagar P.S. Case No. 389 of 2024 dated 11.10.2024 registered for the offences punishable under Sections 103(1) and 238 of the B.N.S.
3. As per the prosecution case, the patrolling party recovered a dead body of a person lying in the bush. The informant took out the dead body from the canal and found cut injury marks on neck and stomach, subsequently in presence of two witnesses, a death inquest report was prepared and the dead body was sent to the Sadar Hospital, Madhubani for postmorterm.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in this case in the confessional statement of the co-accused Buchhi Devi, who has already been granted regular bail by the Co-ordinate Bench of this Court vide order dated 23.06.2025 passed in Cr. Misc. No. 14631 of 2025. It is further submitted that even during the course of investigation there is no material apart from the fact that the petitioner was in touch with the other co-accused persons and nothing has been recovered from the conscious possession of the petitioner. There is no specific allegation against the petitioner rather the allegation of stabbing the deceased to death is against the co-accused Vidya Nand Ram. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 02.06.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.55091 of 2025(2) dt.27-08-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Madhubani in connection with Rajnagar P.S. Case No. 389 of 2024, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
