JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 304B, 201, 34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased and it is alleged that deceased was burnt to death by petitioner and his other family members within one year of her marriage on account of non fulfilment of illegal dowry demand. Para-11 of the case diary goes to show that when deceased was caught in fire, witness Ram Vinay Singh went running to the house of the deceased and found the deceased in fire whereas petitioner was trying to

Patna High Court Cr.Misc. No.39370 of 2016 (4) dt.18-11-2016 2/2 extinguish the fire. This witness stated that immediately deceased was taken to hospital.

Learned counsel for the petitioner submits that deceased was caught in fire accidentally and petitioner tried his best to save the life of the deceased but could not succeed in his attempt.

The aforesaid submission appears to be doubtful because post mortem report says otherwise.

Considering the aforesaid facts and circumstances as well as submissions of the parties, I do not feel it proper to extend the privilege of bail to petitioner and hence, his prayer for bail in connection with Sessions Trial No. 449 of 2016 arising out of Begusarai Muffasil P.S. Case No. 74 of 2016 pending in the court of 7th Additional Sessions Judge, Begusarai stands rejected. However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible.
