JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2016 Heard learned counsels for the petitioner and the State. The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 376,313,315 and 120B of the Indian Penal Code and section 4 of Protection of Children from Sexual Offences Act.
The prosecution case is of ravishing 14-years-olddaughter of the informant on promise of marriage but marriage was not performed and getting the pregnancy terminated. In view of the report of the Superintendent of Police, Madhubani dated 6.9.2016 that the evidence has been closed and the matter is fixed for statement of accused under section 313 Cr.P.C., this court is not inclined to interfere in the matter. This application is, accordingly, dismissed. However, it is expected from the learned 1st Additional Sessions Judge,
Patna High Court Cr.Misc. No.41759 of 2015 (5) dt.07-09-2016 2/2 Madhubani to conclude the trial (TR No. 5 of 2014 arising out of Sakari P.S. Case No. 41 of 2014) expeditiously, preferably within three months keeping in view of the fact that petitioner is languishing in custody.
