JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is languishing in custody since 29.6.2016 in a complaint case filed with accusation under Sections 498A and 406/34 of the Indian Penal Code and section 4 of Dowry Prohibition Act wherein process has been directed to be issued after cognizance being taken.

The basic accusation is of torture for non fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant. The

Patna High Court Cr.Misc. No.42547 of 2016 (2) dt.29-09-2016 2/2 petitioner was granted provisional anticipatory bail vide Cr. Misc. No. 36638 of 2012 on the readiness to keep the complainant as wife with full dignity and honour. The provisional bail of the petitioner was not confirmed due to non compliance of the undertaking and subsequently on the application of the complainant, the bail bonds of the petitioner was cancelled. It is further submitted that the petitioner surrendered on 29.6.2016 and investigation has already concluded.

Considering the nature of accusation and investigation being concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Siwan in connection with Complaint Case No. 597 of 2011.
