Initially the petitioner has filed the writ petition for a direction to the District Teachers Employment Appellate Authority to decide the appeal filed by the petitioner on 19.08.2010. During the pendency of the writ petition the District Teachers Employment Appellate Authority decided the appeal and as such the petitioner has challenged the same by way of filing I.A. No. 6738 of 2016.

Learned counsel for the petitioner now admits that

Patna High Court CWJC No.17319 of 2014(2) dt.25-09-2018 2/2 there is forum of appeal against the decision of the District Teachers Employment Appellate Authority and as such counsel prays that the writ petition may be disposed of with liberty to the petitioner to approach the State Appellate Authority. With the aforesaid liberty, the writ petition stands disposed of.

In case the petitioner files an appeal before the State Appellate Authority within a period of one month from today along with a copy of this order, the State Appellate Authority is required to decide the appeal on its own merit after condoning the delay in filing the appeal in view of the fact that the petitioner was pursuing the writ petition for the same relief before this Court.
