28-02-2022 Heard learned counsel for the parties.
The petitioner seeks bail in Bind P.S. Case No. 51 of 2021, registered for the offence under Sections 302, 201, 120(B), 34 of the Indian Penal Code.
As per the prosecution case, on 23.04.2021, the informant got an information that dead-body of his son is lying near a boring in village Nouranga and when he reached there, he came to know that this petitioner in connivance with other coaccused persons killed the son of the informant. It is submitted on behalf of petitioner that informant is not eye-witness of the occurrence. Neither the informant has disclosed the source of information as to how he came to know about the occurrence nor during course of investigation, anyone has claimed that this petitioner has killed the son of informant. Only material, which has come against the petitioner, is that on
Patna High Court CR. MISC. No.66064 of 2021(2) dt.28-02-2022 2/2 the date of occurrence, the petitioner had talked with the deceased. Petitioner is in custody since 23.06.2021. Investigation is complete.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.
