The petitioner seeks bail in Siswan (Chainpur O.P.) P.S. Case No. 180/2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected vide order dated 05.08.2015 passed in Cr. Misc. No. 11949/2015 with a direction to the trial court to expedite the trial and conclude the same within nine months, but the trial court did not take any action in conclusion of the trial. Summons is directed to be issued vide order dated 05.05.2016. The petitioner is alleged to have assaulted the deceased with spade. Although, simple injury was found but later on Ganga Mahto died after 12 days of the occurrence. The post-mortem report reveals that there was haematoma and on account of which Ganga Mahto died. The

Patna High Court Cr.Misc. No.29720 of 2016 (2) dt.26-11-2016 2/2 petitioner has remained in jail for about two years. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge 2nd, Siwan in connection with Siswan (Chainpur O.P.) P.S. Case No. 180/2014.
