The petitioner seeks bail in a case registered for the offences punishable under sections 323 and 420/34 of the Indian Penal Code and section 138 of the Negotiable Instrument Act.

Petitioner got Rs.2,50,000/- from the informantcomplainant for executing the sale deed but petitioner neither executed the sale deed nor returned the money. Petitioner is ready to refund the entire amount to the complainant within three months.

Considering the facts aforesaid, the petitioner

No.43059 of 2015 (2) dt.17-09-2015 above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Akansha Kashyap, Judicial Magistrate, 1st Class, Gaya in connection with Complaint Case No. 2174 of 2013 subject to the condition that if petitioner fails to return Rs.2,50,000/- to the complainant within three months from the date of his release, the court below shall cancel the bail bond of the petitioner.
