The petitioner apprehends his arrest in a case registered for the offence under Section 414 of the Indian Penal Code and Sections 11(1) (d), (k) of the Prevention of Cruelty to Animals Act, 1960.

As per prosecution, some smugglers were to smuggle some animals from India to Nepal through border pillar and the four buffaloes were seized near border pillar no. 428/01, whereupon petitioner succeeded in fleeing away duping the members of battalion.

Learned counsel for the petitioner submits that the cattle were not recovered from conscious possession of the petitioner neither the petitioner was present at the place of recovery.

Patna High Court CR. MISC. No.66190 of 2021(2) dt.24-05-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, West Champaran, in connection with Bahngaha P.S.
