JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends arrest in connection with Amnour P.S. Case No. 32 of 2014 registered for the offences punishable under Sections 341, 323, 324, 307, 379, 447 and 504 read with 34 of the Indian Penal Code.

It has been contended that there is a case and counter case and both sides sustained minor injuries. The main accused Rajesh Bhagat against whom there is allegation of causing injury with farsa on the head of the informant and co-accused Ram Pukar Bhagat have already been granted bail vide B.P. No. 809 of 2014 as the injury was found simple in nature and case of the petitioner stands on better footing.

Learned counsel for the State has opposed the prayer for anticipatory bail.

No.42183 of 2014 (2) dt.20-03-2015 2 / 2 Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, let the petitioner be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Amnour P.S. Case No. 32 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
