JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be elder brother of husband of the deceased. The dead body of the deceased was recovered near a river, kept in a plastic bag.
No one has seen actual killing of the deceased and in course of investigation, the statement of husband of the deceased was recorded and the husband of the deceased stated that prior to the alleged occurrence, the minor son of his brother, namely, Pappu Yadav was killed, for which, deceased of the present case had gone to jail and the aforesaid Pappu Yadav as well as his brother-in-law had given threatening to kill the deceased of the present case.
Patna High Court Cr.Misc. No.40949 of 2015 (4) dt.14-12-2015 2/2 The postmortem report of the deceased reveals that the doctor could not give any exact cause of the death due to decomposition of deadbody of the deceased.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Shrinagar Pujaha P.S. Case No. 17 of 2015 to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah.
