The petitioner apprehends his arrest in Danapur P.S. case No. 76 of 2019 registered under Section 193, 196, 197, 420, 467, 468, 471, 120B/34 of the IPC.

The gist of the allegation against the petitioner is that petitioner is a witness on the fraudulent sale deed executed by Binod Kumar Choudhary with regard to his ancestral land although there was partition and Binod Kumar Choudhary and his father had already sold the land of their share. The learned counsel for the petitioner submits that, of course, the petitioner has got criminal antecedent but the petitioner did not commit any crime. The petitioner is simply a witness on the sale deed executed by Binod Kumar Choudhary.

No.55219 of 2019(2) dt.03-09-2019 2/2 Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that petitioner is simply a witness on the sale deed, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Danapur, Patna in connection with Danapur P.S. case No. 76 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
