JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 25.04.2015 in connection with Mirganj P.S. Case No. 109 of 2015(G.R. No. 1031 of 2015) for the offences instituted under Sections 341, 307, 326, 120(B)/34 of the IPC and 27 of the Arms Act. The prosecution story, in brief, is that while the informant was returning after meeting the local M.L.A., all the accused persons intercepted the informant and fired upon the informant in the manner stated in the FIR. There is a separate allegation of firing against the present petitioner. It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.40566 of 2015 (3) dt.24-11-2015 2/2 petitioner has got no criminal antecedent. The petitioner is in custody since 25.04.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering of the evidence against the petitioner. No specific injury has been attributed against the petitioner. From perusal of Annexure-6, it would appear that the nature of injury could not be ascertained by the doctor as the informant did not got himself treated at the Sadar Hospital, Gopalganj. The petitioner has falsely been implicated in the present case due to political reason.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj, in connection with Mirganj P.S. Case No. 109/2015(G.R. No. 1031 of 2015).
