JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 363, 365, 366A/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with co-accused, Mantu Mehta, kidnapped the minor daughter of the informant for the purpose of marriage.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that the occurrence took place on 19.08.2021 but the FIR was lodged on 23.08.2021 without any explanation for delay. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that the victim in her

Patna High Court CR. MISC. No.66044 of 2021(5) dt.07-11-2022 2/2 statement u/s 164 of the Cr. P. C. fully supported the prosecution case. The court has assessed the age of victim between 14-15 years.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
