JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Accusation against petitioner is that he along with several others First Information Report named accused persons made attempt to kidnap the informant's daughter. But submission on behalf of the petitioner is that prior to the institution of the present case one Bhagwan Bazar P.S. Case No. 64 of 2014 was lodged against the petitioner and others in respect of kidnapping of victim of the present case and in the aforesaid case the statement of the victim was recorded under Section 164 Cr.P.C.

in which she admits the factum of her marriage with the petitioner and as a matter of fact, when petitioner got bail in the above stated case the informant lodged this false case again against the petitioner.

Patna High Court Cr.Misc. No.42429 of 2015 (2) dt.17-09-2015 as well as submission of the parties, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bhagwan Bazar P.S. Case No. 190 of 2014 to the satisfaction of Sri Shailendra Kumar Rai, Judicial Magistrate, Ist Class, Chapra (Saran).
