====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 20-09-2018 Heard Sri Shivendra Kumar Sinha, learned counsel for the petitioner and Sri Atul Chandra, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Singhwara P.S. Case No. 83 of 2017 registered for the offence under Sections 406 and 420 of the Indian Penal Code, has prayed for grant of bail, in the event of his arrest or surrender. Learned counsel for the petitioner submits that the petitioner was not having any authority, even then the petitioner has been made accused on an accusation of taking illegal money for the purposes of removal of encroachment and, as such, according to learned counsel for the petitioner, it is a fit case for grant of anticipatory bail.

Learned Addl. Public Prosecutor has opposed the

Patna High Court Cr.Misc. No.58736 of 2018(2) dt.20-09-2018 2/2 prayer for grant of anticipatory bail and submits that the petitioner is husband of the Sarpanch and in that capacity, he has committed such crime.

Considering the facts and circumstances, I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
