Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 324, 504, 506, 307, 354(B) and 379 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Gogri

Patna High Court CR. MISC. No.66959 of 2021(2) dt.02-06-2022 2/3 P.S.Case No. 244 of 2020.

As per the allegation, 15 named accused persons including the petitioners badly assaulted the informant and his mother. They assaulted Md. Mustaque, Md. Izhar, Md. Umar Farooq and Md. Murtaza. Co-accused Vidya Yadav opened fire, but the informant escaped.

The learned counsel for the petitioners has submitted that there is case and counter case and members of the petitioners' side have also sustained injuries. He has submitted further that some injuries are grievous, but have not been attributed against petitioners' side, rather the allegation is general and omnibus.

On the other hand, the learned APP has opposed the prayer for bail.

Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Gogri P.S.Case No. 244 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Patna High Court CR. MISC. No.66959 of 2021(2) dt.02-06-2022 3/3 Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
