ANJANA MISHRA ORAL ORDER 16-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 214 of 2015 for the offences registered under Section 302 of the Indian Penal Code. Diary of the present case was called for, which has since been received.

Learned counsel for the petitioner submits that the name of the petitioner has surfaced on the confessional statement made before the police by one Randhir Kumar Mahato, who is brother of the deceased.

Learned counsel for the State submits that save and except the confessional statement made before the police, which has no evidentiary value, there is no cogent material in the case diary to support the allegation as against the petitioner.

Patna High Court Cr.Misc. No.30458 of 2016 (3) dt.16-11-2016 Considering the aforementioned facts and circumstances of the case and that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No. 214 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
