Petitioners seek regular bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code and u/s 25(1-b)a, 26, 27 of Arms Act. .

Learned counsel appearing for the petitioner submits that petitioners are not named in the FIR. The name of petitioners have transpired in this case during the course of investigation in the confessional statement of co-accused, Bibhash Mishara, who has stated that these petitioners were also conspirators and got Rajesh Kumar Raman, the deceased killed. It is submitted that the occurrence took place on account of

Patna High Court CR. MISC. No.66304 of 2021(5) dt.25-04-2022 2/2 political rivalry between Sanjeev Yadav and Rajesh Kumar Raman (the deceased) and petitioners have no concern with their political activity. Petitioners are in custody since 07.07.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak PS case No. 156/2020.
