The petitioner seeks bail in a case registered for the offences punishable under Sections 407, 411, 413 and 34 of the Indian Penal Code and under Section 7 of the E.C. Act. One truck loaded with rice of F.C.I., Mokama was recovered. Some rice was also found in a hut situated near a tube well. The petitioner is running a hotel and it was suspected that the petitioner might have kept rice in the hut. The petitioner is not named in the FIR and on mere suspicion name of the petitioner figured in the case. Similarly situated co-accused Bhairo Singh @ Perveen Singh has already been enlarged on bail vide order passed in Cr. Misc. No. 28096 of 2014 and the case of the petitioner stands on better footing.
Considering the facts aforesaid, the petitioner above

No.41727 of 2015 (2) dt.15-09-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Barh, Patna in Mokama P.S.
