The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354, 435, 353, 332, 333, 379, 427 and 504 and 120(B) of the IPC.

The prosecution case, as per the written report of Parikshan Paswan, A.S.I., Nabinagar P.S., submitted to the Station House, Nabinagar Police Station, is to the effect that the mob was protesting against the death of a boy who died in a road accident on 25.02.2018. When the police came at the occurrence to pacify the matter, then the mob started pelting stones and also assaulted the police party with lathi, bottle etc. It is further alleged that the mob damaged the police jeep also. It is submitted by the learned counsel for the petitioner that

No.61784 of 2018(2) dt.10-12-2018 2/2 the accusation against the petitioner is omnibus and general in nature and the FIR has been lodged against 51 named and 400 unknown accused persons. It is further submitted that some of co-accused persons have been granted privilege of vide Cr. Misc. Nos. 53511 and 49216 of 2018.

It is submitted by the learned APP that the accusation is specific against the petitioner.

Considering the fact the accusation is against the mob and other co-accused persons have been granted privilege of anticipatory bail by co-ordinate Benches of this Court, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Nabinagar P.S. Case No. 47 of 2018 subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J) Deepak/Rahul/- U T
