Petitioner, apprehends his arrest in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Informant has alleged that while he was sitting on the P.C.C. road along with his associates and when they went away two unknown persons riding on motorcycle passed and thereafter returned back and finding him alone fired two shots upon him which hit in his stomach. It is further alleged that thereafter petitioners and other accused brandishing revolver in their hands ran towards him instigating them to kill him however on alarm being raised all of

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to admitted disputes of property. There is no allegation of firing against him or causing any assault or injury to the informant.

Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on prearrest bail on furnishing bail bond of Rs. 20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara Town P.S. Case No. 215 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
