The petitioners are apprehending arrest in a case registered for the offences punishable under Section 414 of the IPC and Sections 25(1-b), 26 and 35 of the Arms Act.

The prosecution case is that from the room of the father of the petitioner, Nagendra Singh, a country made pistol and 20 live cartridges were recovered, whereas from the room of the petitioner, one country made rifle and 30 live cartridges were recovered. It is further alleged that three country made pistols and 41 live cartridges were recovered from the straw house and a theft car was also recovered, which was parked at his house. It is submitted by the learned counsel for the petitioner that

Patna High Court Cr.Misc. No.62008 of 2018(2) dt.11-12-2018 2/2 no recovery has been made from the conscious possession of the petitioner.

Considering the nature of recovery made from the house of the petitioner, this Court is not inclined to enlarge the petitioner on anticipatory bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if he surrenders before the learned Court below, within a period of six weeks, in connection with Magadh Medical P.S. Case No. 185 of 2018 pending in the Court of learned A.C.J.M., 4th , Gaya.
