The petitioner is in custody since 19.01.2019 in connection with Barauni (Rail) P.S. Case No.194/2018 for the offence punishable under Sections 328,307 and 379 of the IPC. Learned counsel for the petitioner submits that the petitioner is a poor tea vendor and the FIR and the case have been lodged after delay of almost seven months as the date of occurrence is said to be 10.05.2018 and the case has been registered on 09.12.2018. It is further submitted that the petitioner's name surfaced in confessional statement made before the police by co-accused Vicky who has since been extended privilege of bail on 22.02.2019 in Cr. Misc. No.10159/2019.

In view of the aforementioned facts and

No.55727 of 2019(2) dt.19-09-2019 2/2 circumstances of the case and the period of custody and the petitioner has got no criminal antecedent, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Railway, Barauni, Begusarai in connection with Barauni (Rail) P.S. Case No.194/2018.
