JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 28.09.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

It would appear from perusal of the impugned order that earlier petitioner was on bail but his bail bond was cancelled on 3.12.2003 as he failed to appear before the court. Subsequently, petitioner was declared absconder vide order dated 7.11.2013. Learned counsel for the petitioner submits that learned court below has committed error on the record observing that the petitioner was arrested by the police on 12.6.2015 and, as a matter of fact, petitioner voluntarily surrendered before the court below on 12.6.2015.

No doubt, it is long misuse of privilege of bail but taking into consideration the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the

Case no. 18/1997 subject to the condition that petitioner shall attend the learned trial court in person on each and every date for the period of nine months or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any reasonable explanation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
