The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
The daughter of the informant died in her matrimonial house after seven years of marriage, leaving behind three children, including a daughter aged about eight years. The allegation is of demand of dowry and torture for the same and commission of dowry death for non-fulfillment of dowry demand. The petitioner is mother-in-law of the victim. The allegation is general and omnibus. Presumption of dowry death is not there against the petitioner. Hence, let the petitioner, above named, in the event of her arrest or surrender
Patna High Court Cr.Misc. No.61392 of 2018(2) dt.19-11-2018 2/2 before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Nadi Police Station Case No.44 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
