JUSTICE GOPAL PRASAD ORAL ORDER 24-04-2015 Learned counsel for the petitioners submits that petitioner nos. 2, 3 and 4 have already been arrested and hence this anticipatory bail application against them has become infructuous. Hence, the petition on behalf of petitioner nos. 2, 3 and 4 has become infructuous.

Heard learned counsel for the petitioner no. 1 and the State.

This is a petition for grant of anticipatory bail for the offences punishable under Section 420 of the Indian Penal Code.

It is alleged that the sale deed was executed at higher rate. However, the amount paid was less than the rate of agreement.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.41557 of 2014 (4) dt.24-04-2015 petitioner no. 1 that there is no allegation that under what condition lesser amount was paid.

Hence, having regard to the facts and circumstances of the case, the petitioner no. 1, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each in connection with Vaishali P.S. Case No. 43 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hazipur subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
