Petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 326, 327, 307, 384, 354, 379, 452, 504 and 506 of the Indian Penal Code.
According to FIR, petitioner no. 1 Md. Mansoor, allegedly, caused injury at the head of Badruddin with sword and petitioner no. 2 Md. Ishak @ Munna caused injury with spear to Badruddin at his hand.
Both the petitioners are in custody since 02.08.2017. The Doctor has found simple injury on the person of the injured.
Learned counsel for the informant opposed the
Patna High Court Cr.Misc. No.59565 of 2017 (6) dt.16-03-2018 2/2 prayer for bail on the ground that in the event of release, the petitioners would obstruct early disposal of the trial. Moreover, the petitioners are accused in the murder case of the younger son of the informant.
Considering the fact that trial is still pending and the petitioners are in custody since about last seven months, the Doctor has not found any grievous injury, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chhatapur Police Station Case No. 308 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
