JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Akbarpur P. S. Case No. 177 of 2018 registered for the offences punishable under Sections 147, 148, 341, 323, 307, 379, 447, 504 and 506 of the Indian Penal Code.

The accusation against the petitioners is that they assaulted the informant and his other family members on 23.06.2018 as well as on 11.07.2018.

Submission on behalf of the petitioners is that for the so-called occurrence of 23.06.2018 no case was registered and so far as occurrence of 11.07.2018 is concerned, injured are said to

Learned counsel for the petitioners further submits that previous enmity is admitted in the F.I.R itself. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Nawada in Akbarpur P. S. Case No. 177 of 2018 subject to conditions as laid down under Section 438(2) of the Cr. P. C.
