The petitioners are apprehending their arrest in a case registered under Sections 302, 120B and 34 of the Indian Penal Code.

The prosecution case, in short, is that the son of the informant was called by the accused persons and whereafter he did not return and later his dead body was found. It has been submitted on behalf of the petitioners that the petitioner no. 2 has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioners are not named in the F.I.R. The

Patna High Court Cr.Misc. No.66277 of 2018(2) dt.19-12-2018 2/2 names of the petitioners have transpired in course of investigation at the instance of mother of the deceased. The mother of the deceased has raised a suspicion in respect of the involvement of the petitioners in the present case. There is no eye witness to the alleged occurrence. Other co-accuseds have been granted anticipatory bail vide order dated 04.10.2018 passed in Cr. Misc. No. 61146 of 2018.

On behalf of the State, it is submitted that the petitioners are not named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Udakishunganj, Madhepura in connection with Alamnagar (Ratwara O.P.) P.S. Case No. 21/2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
