JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Sour Bazar P.S. Case No. 266 of 2018 dated 09.05.2018 instituted for the offences under Sections 341, 323, 379, 380, 324, 354, 384, 427, 504, 506, 34 of the Indian Penal Code.

The informant, who is wife of Chaukidar has alleged that the petitioners who are their neighbours entered into her house and on gun point, took away her belongings and also assaulted the family members of the informant. The learned counsel for the petitioners has

Patna High Court Cr.Misc. No.63476 of 2018(2) dt.12-12-2018 2/2 submitted that earlier also such case was lodged against the petitioners at the instance of the informant and her family members. It has further been submitted that because they being neighbours and not on cordial term with the informant, such litigation is being engineered by the family members of the informant.

Regard being had to the aforesaid facts as also taking into account that the allegations levelled are not serious, the petitioners, above named, in the event of their arrest or surrender within a period of four weeks from today before the learned Court below, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 266 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
