The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366(A), 341, 323, 307, 504, 506, 34 of the Indian Penal Code.

It is alleged that this petitioner along with coaccused Raushan Kumar had assaulted the informant with iron rod and stick while he was returning his village from duty and when his father came to his rescue, he was also assaulted by the accused persons. It is also alleged that co-accused Raushan Kumar had abducted

Patna High Court CR. MISC. No.66656 of 2021(3) dt.05-07-2022 2/3 minor daughter of the informant in connivance with this petitioner for marriage purposes.

It is submitted by learned counsel for the petitioner that there is no specific overt act against the petitioner. The petitioner is a student and studying in B.Com.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner and submitted that the victim in her 164 Cr.P.C statement has specifically alleged against this petitioner that he along with Suraj and Raushan had threatened the victim that if she does not flee away with co-accused Raushan Kumar, they will kill her father. Hence, out of fear, she went with Raushan Kumar and solemnized marriage and subsequently conceived. It is alleged that Raushan Kumar fled away leaving the victim alone. Thereafter, the victim alone came to her native village.

Considering the fact that the petitioner had

Patna High Court CR. MISC. No.66656 of 2021(3) dt.05-07-2022 3/3 played active role in forceful elopement of the victim and made assault to the informant and his father, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner stands rejected.
