JUSTICE BIRENDRA KUMAR ORAL ORDER 14-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 295/379/414 of the Indian Penal Code.

According to FIR, besides allegation of damaging the idol in a temple allegation against the petitioner is that from his house a stolen motorcycle was recovered. Petitioner is in custody since 08.11.2017.

Submission is that the petitioner has got no criminal antecedent and investigation is already complete. The petitioner is ready to cooperate with the trial.

Considering the recovery of stolen property from

Patna High Court Cr.Misc. No.1527 of 2018 (4) dt.14-03-2018 P2/ the possession of the petitioner, let the petitioner, above named, be released on bail after framing of the charge or on completion of six months of custody whichever is earlier, on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Mairwa P.S. Case No.418 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
