The petitioner seeks bail in connection with Khagaria (Chitragupta Nagar) P.S. Case no. 514 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code.
Rs. 3,29,300/- is said to have been looted by four unknown motorcycle borne criminals from the collection centre of Satine Care Finance Ltd.
It is submitted by the learned counsel for the petitioner that neither the petitioner is named in the FIR nor any incriminating article has been recovered from his conscious physical possession. The petitioner happens to be Manager of the Collection Centre and was not present at the place of
Patna High Court Cr.Misc. No.50381 of 2017 (2) dt.18-10-2017 occurrence and at the time of occurrence. Nothing in the record indicate his complicity in the occurrence barring confessional statement of co-accused Abhimanyu Singh which has no evidentiary value in the eye of law. The allegation levelled against the petitioner is not specific rather omnibus. The petitioner has been languishing in custody since 7.08.2017. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S. Case no. 514 of 2017.
