The petitioners apprehend their arrest in Barouli P.S. Case No.325 of 2018 registered under Sections 341, 323, 324, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code. The informant named the petitioners and alleged that on the order of Sudama Manjhi, Ajit Manjhi inflicted farsa blow over the head of his brother with an intention to kill him and his brother got fracture injury on his head. Arvind Manjhi assaulted the informant with iron rod causing fracture injury in his right wrist. Bikash Manjhi is said to have snatched Rs.5,000/- from his pocket and a chain made of gold.

The learned counsel for the petitioners submits that there is no allegation of assault against both the petitioners.

Ajit Manjhi, who is alleged to have assaulted the brother of the informant with farsa, and three others have already been enlarged on regular bail vide order passed in B.P. No.173 of 2019.

Taking into consideration the fact that there is no allegation of assault against both the petitioners and petitioner No.2 is only alleged to have snatched money and chain from the possession of the informant, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIV, Gopalganj in connection with Barouli P.S. Case No.325 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
