The petitioner being the husband of the informant is languishing in custody since 27.02.2016 in a case registered for the offences punishable under sections 498A, 494/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand and performing second marriage with one Sobha Devi.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and has not performed second marriage. A statement to that effect has been made in paragraph 9 of the petition, which reads as under :- "That the petitioner has not performed any second

It is further submitted that the impugned order reflects that the investigation has already concluded and final report has been submitted.

Considering the same, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria, in connection with Sikty P.S. Case No.127/2015.
