ANJANA MISHRA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 31.03.2017 in connection with Bihariganj P.S. Case No.109 of 2017 registered for the offence under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the recovery which is alleged to have been made is not from the conscious possession of the petitioner.

As such, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate,
