ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 03.07.2019 in connection with Excise Case No.732 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the alleged recoveries were made from the motorcycle which did not belong to the petitioners and hence, not from their conscious possession. It is further submitted that so far as criminal antecedent of petitioner no.1 is concerned, he has involved in one another case of similar nature in which he is on bail and so far as petitioner no.2 is concerned, he has no criminal

Considering the aforementioned facts and circumstances, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-Cum- Special Judge (Excise), Aurangabad, in connection with Excise Case No.732 of 2019.
