JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 09-02-2022 Heard learned counsel for the petitioner and Mr. Ram Priya Saran Singh, learned A.P.P. for the State. This is the second attempt of the petitioner to obtain bail in connection with Laukahi P.S. Case No. 97 of 2017 corresponding to G.R. No. 829/2017 registered for the offence under Section 392 of the Indian Penal Code.

Earlier his prayer for bail was rejected vide order dated 21.10.2020 passed in Cr. Misc. No. 27328/2020. This Court has noticed the huge criminal antecedents of 22 cases against the petitioner and further that he was absconding in most of the cases.

Considering the submission of learned A.P.P. for the State that release of the petitioner would not allow the cases pending against him to proceed as he was still being remanded

Patna High Court CR. MISC. No.66707 of 2021(4) dt.09-02-2022 2/2 in several cases in which he was an accused, this court while rejecting the prayer for bail of the petitioner directed the Superintendent of Police, Madhubani to take appropriate steps to ensure that prosecution cooperates with the trial in all the cases pending against the petitioner.

This court has called for a report in the present case. Report has been received. Further the Superintendent of Police, Madhubani has also submitted his report. He has informed this court that out of 22, cases 16 cases have been verified and rest of the cases are to be still verified from the police stations falling within the district of Supaul and Madhubani. Considering that there is no change of circumstance and the petitioner has got huge criminal antecedents and further that petitioner was absconding in several cases for about nine years, this Court is not inclined to release the petitioner on bail.
