2. The contention of the petitioner is that he has deposited the requisite amount for measurement and demarcation of his land the second time, however, no measurement has been carried out.

3. The learned AC to SC-25 submits that they have filed a supplementary counter affidavit stating therin that there was no provision for second measurement and demarcation once it was already done and if the petitioner wants, he can receive the amount which was deposited the second time.

Having perused the records, it seems that the case is of 2022 and already almost four years have passed and at this relevant time relegating the petitioner to accept the amount and move ahead in appeal does not seem proper and, therefore, this Court directs the Circle Officer, Raniganj, district- Araria to carry out the demarcation afresh in presence of all the parties and to submit a report with regard to the demarcation having been done with the signatures of the parties thereon.

5. The entire exercise should be completed within the period of two months from the date of the receipt of the reproduction of the copy of this order.

6. The application stands disposed off with the aforesaid directions.
