JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-11-2015 Counter affidavit is filed on behalf of the informant. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report along with others but submission on behalf of the petitioner is that after due investigation, police submitted charge sheet under section 363 /34 of the Indian Penal Code which is bailable in nature but the learned court below took cognizance of the offence under section 364/34 of the Indian Penal Code which is not applicable in the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.41891 of 2015 (3) dt.09-11-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Chhatauni P.S.Case No. 150 of 2015.
