JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 224 of 2018 instituted for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Five litres of counter made liquor is said to have been recovered from a hut which is stated to be in joint possession of the petitioner and others.

The learned counsel for the petitioner has submitted that petitioner has not been residing in that hut for several months and therefore he has no idea as to who had kept the prohibited articles in the aforesaid hut.

No.66504 of 2018(2) dt.14-12-2018 2/2 Regard being had to the aforesaid facts viz. the recovery of illicit liquor from a hut which is in joint possession of many persons and clean antecedents of the petitioner, the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today before the learned Court below, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions JudgeVI-cum-Special Judge, Excise Act, Samastipur in connection with Excise Case No. 224 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
