The petitioners apprehend their arrest in connection with Complaint Case No. C-2020 of 2017 registered under Sections 323, 427, 504 of the Indian Penal Code and Section3/4 of the Witchcraft Practices Prohibition Act, 1999. Petitioners and other accused persons are said to have assaulted the complainant. They also addressed her dian and administered dirt.
It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. There is
Patna High Court Cr.Misc. No.63296 of 2018(2) dt.19-12-2018 2/2 land dispute between the parties and prior to this case, petitioner no. 2 Ramnarayan Sah had lodged a case against the husband of the complainant in the year 2014. The allegation levelled against them is general and omnibus. In the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 7th Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Complaint Case No. 2020 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
