The petitioner apprehends his arrest in Barachatti P.S. Case No. 100/2016, registered for the offences punishable under Sections 47 (A) of the Bihar Excise Act.
The police raided the house of the petitioner and his brothers and 10 litres country made liquor from the house of the petitioner and 10 litres country made liquor from the house of the brother of the petitioner was recovered.
Learned counsel for the petitioner submits that no liquor has been recovered from the house of the petitioner. Only 10 litres country made liquor was recovered from the house of the brother of the petitioner.
It appears from the seizure list that 10 litres
Patna High Court Cr.Misc. No.30155 of 2016 (2) dt.09-09-2016 2/2 country made liquor was recovered from the house of the petitioner and from the house of his brother. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
