The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, on secret information having been received about the three named accused persons including the petitioner herein getting liquor on a small boat, it is stated that a raid was conducted. About 240 litres of liquor was recovered from the boat, however the three accused persons including the petitioner herein managed to escape. It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. Patna High Court CR. MISC. No.66493 of 2021(2) dt.26-04-2022 2/2 Bihar Prohibition and Excise Act, 2016. He is in custody since 28.9.2021 and investigation in the case has concluded. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the fact that the petitioner was not arrested at the spot together with the petitioner having remained in custody for more than 6 months, the Court directs the petitioner to be enlarged on bail in connection with Revilganj P.S. Case no.308 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Chapra, District Saran.
