JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim has already returned to her home and her statement was recorded under section 164 of the Cr.P.C . It would appear from perusal of the impugned order that the victim supported the prosecution case in her statement recorded under section 164 of the Cr.P.C but fairly admitted that co- accused Pawan Kumar Sah wanted to marry her.

Learned counsel appearing for the petitioner submits that petitioner happens to be father of co-accused Pawan Kumar Sah and as a matter of fact, the victim eloped with the aforesaid Pawan Kumar Sah on her own sweet will but later on she was recovered and took U- turn under the pressure of her family

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Rosera, District-Samastipur in connection with Hasanpur P.S.Case No. 135 of 2015.
